During the 1976 ABA-NBA merger, Donald Schupak represented the owners of the Spirits of St. Louis as an attorney. Sports Illustrated dubbed the NBA’s purchase of the Spirits, which included Schupak’s ownership stake, “the best sports deal of the century.” In June 1976, the American Basketball Association agreed to pay the Spirits of St. Louis owners (primarily Ozzie and Daniel Silna) $2.2 million in cash up front in exchange for the team ceasing operations. The Denver Nuggets, Indiana Pacers, New York Nets, and San Antonio Spurs are the former ABA teams. The NBA’s television rights were sold to CBS and then NBC as the league’s popularity grew in the 1980s and 1990s, and further agreements were made with the TNT and TBS cable networks; league television income skyrocketed into the hundreds of millions of dollars. Despite the fact that the Spirits never played an NBA game, the Silnas have received roughly $100 million from the NBA over the last 25 years. The Silnas continue to receive annual checks from the NBA, which represent a 4/7 portion of the television money that would usually go to any NBA team, or approximately 2% of the total league’s TV money. The Silnas earned millions in the 1980s and at least $4.4 million each year in the 1990s as a result of their agreement during the ABA-NBA merger. The agreement paid the Spirits’ owners at least $12.53 million each year from 1999 to 2002, and at least $15.6 million per year from 2003 to 2006. Each of the two Silna brothers receives 45 percent of the total television income.
